DONATION ACCEPTANCE POLICY AND TERMS OF USE
1. Legal Framework
This policy governs donation acceptance, online payment procedures, data protection, and liability limitations of Yetim Eli France.
The Association operates under French Law of 1 July 1901, the French Consumer Code, the Monetary and Financial Code, and EU Regulation 2016/679 (GDPR).
2. Discretionary Acceptance
Acceptance of any donation is at the sole discretion of the Association.
No donation will be accepted unless it can be used in accordance with the Association’s mission.
Irrevocable gifts that may jeopardize the donor’s financial security will not be accepted.
The Association does not provide tax or legal advice.
3. Types of Donations
Accepted donations may include:

In-kind services (subject to approval)
Real estate, personal property, illiquid securities, or restricted gifts require prior review.
4. Final and Non-Refundable Donations
Donations are voluntary gifts.
Under Article L221-28 of the French Consumer Code, withdrawal rights do not apply.
All confirmed donations are final and non-refundable, except in cases of manifest material error.

Transactions are secured via SSL/TLS encryption.
Credit card information is not stored on the website and is processed exclusively by certified payment providers under EU PSD2 regulations.
6. Transparency and Video Sharing
For certain projects, photos or videos may be shared for informational purposes.
A valid phone number and WhatsApp access are required.
Such sharing is not contractually guaranteed.
7. Tax Receipts and Valuation
Tax receipts may be issued where legally applicable.
Except for cash and publicly traded securities, no monetary valuation is assigned.
8. Data Protection and Anonymity
Personal data is processed in accordance with GDPR.
Data is used solely for donation processing, tax receipts, and project communication.
Anonymous donations are respected.
Data is never sold or transferred.
9. No Third-Party Compensation
No commission, referral fee, or compensation is paid to any third party in connection with donations.
10. Limitation of Liability
The Association shall not be liable for:

Payment provider failures

Fraud beyond its control

Failure to send visual materials due to incorrect contact details
Liability is strictly limited to the amount of the donation concerned.
11. Governing Law
These provisions are governed by French law.
Disputes fall under the jurisdiction of French courts.
